We cannot emphasize enough the importance of having these documents made. There are two types of LPAs: one for Property & Financial Affairs and one for Health & Welfare.
Some people believe that, as they are married, their spouse has an automatic right to make decisions about their husband or wife’s affairs, but this is not necessarily the case. Only by having the correct LPAs in place, can a spouse (or whoever you appoint) can act legally. What if you are not married to the person you are living with? They would have no legal right to make decisions about your finances or level of care.
Some people also believe that, as they are fit and well at the moment, they do not need to think about LPAs, but unfortunately, no-one knows when something may happen. You may fall ill very suddenly, or be affected by a progressive illness, so the sooner your LPAs are made, the better.
